Drug and Alcohol Testing
For Safety-Sensitive Employees
The United States Congress recognized the need for a drug and alcohol-free transportation industry, and in 1991 passed the Omnibus Transportation Employee Testing Act, requiring DOT agencies to implement drug and alcohol testing of safety-sensitive transportation employees. 49 CFR Part 40, or Part 40 as we call it, is a DOT-wide regulation that states how to conduct testing and how to return employees to safety-sensitive duties after they violate a DOT drug and alcohol regulation.
Testing positive for drugs or refusing a drug test, requires specific procedures and consequences under the U.S. Department of Transportation (DOT) regulations:

Positive Test Result:
- If a CDL driver tests positive for drugs, they are not permitted to perform safety-sensitive duties for any DOT-regulated employer.
- The employee must see a Substance Abuse Professional (SAP) and successfully complete the return-to-duty process which includes a Federal return-to-duty drug test.

Refusal to Test:
- Refusing to submit to a drug or alcohol test is also considered a violation.
- The determination of refusal may be made by medical review officers (MROs) or alcohol technicians, or it may be the employer’s responsibility.
- Refusals can result in similar consequences as positive test results.

Drug & Alcohol Clearinghouse:
- The Drug & Alcohol Clearinghouse is an online database that provides real-time access to information about CDL driver drug and alcohol program violations.
- Employers and government agencies can query the Clearinghouse for violation information.
- CDL drivers can consent to employers viewing their Clearinghouse record or review their own driver record.
