Drug and Alcohol Testing

For Safety-Sensitive Employees

The United States Congress recognized the need for a drug and alcohol-free transportation industry, and in 1991 passed the Omnibus Transportation Employee Testing Act, requiring DOT agencies to implement drug and alcohol testing of safety-sensitive transportation employees. 49 CFR Part 40, or Part 40 as we call it, is a DOT-wide regulation that states how to conduct testing and how to return employees to safety-sensitive duties after they violate a DOT drug and alcohol regulation.

Testing positive for drugs or refusing a drug test, requires specific procedures and consequences under the U.S. Department of Transportation (DOT) regulations:

  1. Positive Test Result:
    • If a CDL driver tests positive for drugs, they are not permitted to perform safety-sensitive duties for any DOT-regulated employer.
    • The employee must see a Substance Abuse Professional (SAP) and successfully complete the return-to-duty process which includes a Federal return-to-duty drug test.
  2. Refusal to Test:
    • Refusing to submit to a drug or alcohol test is also considered a violation.
    • The determination of refusal may be made by medical review officers (MROs) or alcohol technicians, or it may be the employer’s responsibility.
    • Refusals can result in similar consequences as positive test results.
  3. Drug & Alcohol Clearinghouse:
    • The Drug & Alcohol Clearinghouse is an online database that provides real-time access to information about CDL driver drug and alcohol program violations.
    • Employers and government agencies can query the Clearinghouse for violation information.
    • CDL drivers can consent to employers viewing their Clearinghouse record or review their own driver record.

Remember, safety is paramount in the transportation industry, and adherence to drug and alcohol regulations helps keep our roadways safer for everyone.
